Through the notice-and-takedown (NTD) form, you have the opportunity to report illegal content on our website. The NTD procedure is initiated through a request (Notice) and may, after determining the presence of illegal content, result in the removal of the identified content (Take Down) from our website. 1. What can you report through an NTD notification to Bigshopper?
To submit an NTD notification, it is necessary for the product or information on our website to be identified as illegal or unlawful. For the definition of illegal content, we adhere to the definition according to Regulation (EU) 2022/2065 (see also: Regulation (EU) 2022/2065). Illegal content includes: any information that, on its own or in connection with an activity, including the sale of products or the provision of services, contravenes Union law or the law of a Member State in conformity with Union law, regardless of the precise subject or nature of that law.
This specifically concerns the following content:
- Violation of intellectual property rights: involves copyright infringement, trademark infringement, patent infringement, and other forms of intellectual property rights violation. It may include the unauthorized sharing or use of copyrighted material, trademarks, patents, etc.
- Hate speech or discriminatory content: involves information that incites hatred, discrimination, violence, or hostility based on characteristics such as race, gender, religion, sexual orientation, etc.
- Terrorist propaganda: information that calls for or spreads propaganda for terrorist activities, violence, or extremism.
- Defamation or slander towards the complainant: false statements that can harm the reputation of the complainant.
- Threats towards the complainant: information containing threats, intimidation, or violence.
- Child pornography: content that includes sexually explicit material involving minors.
- Obscene content: material considered offensive, sexually explicit, or inappropriate.
- Trade in illegal goods: content related to the sale or distribution of illegal goods, such as drugs, stolen goods, prohibited weapons, etc.
- Illegal activities: content that incites, advises, or encourages involvement in illegal activities, such as drug trafficking, fraud, hacking, etc.
- Privacy infringement: the publication of personal information, such as private photos, addresses, or medical records, without the consent of the complainant.
- Violation of confidentiality: the disclosure of confidential information without proper consent.
- False information: dissemination of false information that can be harmful to individuals, businesses, or society as a whole.
It is important to provide evidence with your NTD notification that demonstrates the actual existence of illegal content and the grounds for its illegality.
2. How do you submit an NTD notification to Bigshopper?
- Go to the NTD notification form.
- Fill out the form completely and truthfully.
- Don't forget to include the required supporting documents!
- Upon submitting the form, you will receive confirmation of the receipt of your notification.
3. What happens next?
- Upon receiving the NTD notification form, we will process it within two working days at the latest.
- We will check if the NTD notification form is filled out correctly and if all information and documents have been provided.
- If the form is filled out incorrectly or if there is missing information or documents, we cannot proceed with the complaint. If we do not process the form, we will always provide feedback to the complainant.
- If the form is correctly filled out, and we have all the necessary information, we will proceed with the form.
- We will assess whether it is clear that the content in question is illegal.
- If the content can be considered illegal, we will remove the illegal content from our website or make access to it impossible.
- If it is not immediately clear whether the content can be considered illegal, we will, as part of a fair hearing, first contact our client, asking them to respond to the reported complaint. We provide the client with a period of two working days within which we expect a response. Depending on the client's reaction, we decide whether to remove the content from our website or make access to it impossible.
- If the content cannot be considered illegal, your report will be rejected, and we will explain why we made this decision.
